Tomahawkin (“Company”) agrees to deliver, set up, operate, and remove the mobile axe throwing trailer at the event location. At least one Company representative will remain on-site throughout the event, including setup and takedown. The Company will instruct participants and oversee the event to ensure safety and enjoyment.

While every effort will be made to ensure the axe throwing unit remains fully operational throughout the event, temporary interruptions may occur for target changes, maintenance, weather, or unforeseen issues. If the axe throwing unit is not operational for the full duration, the Company may offer an extension of time, partial refund, or reschedule based on time lost.

Renter agrees to pay the full amount due at the time of booking. Events located beyond a 50-mile radius of Lebanon, TN will incur a $50 travel fee. For distances over 100 miles, a custom travel quote will be provided upon request. Payments are non-refundable if cancellation occurs within 7 days of the scheduled event.

If the Renter wishes to extend the event duration on the day of the event, additional time will be billed at $175 per hour.

• Renter-Initiated Cancellation: Cancellations made at least 7 days prior to the event date will receive a full refund. Cancellations made within 7 days of the event are non-refundable.
   
• Company-Initiated Cancellation: If the Company must cancel for any reason, the Renter will be notified immediately and offered either a full refund or the opportunity to reschedule.

The Company will handle delivery, setup, and removal of all equipment. Renter must provide access to the event site 60–90 minutes before and 60–90 minutes after the event for setup and takedown.

The Renter is responsible for ensuring the availability of a reasonably flat 12' x 40' space (minimum), free of obstructions such as low-hanging branches, overhead power lines, underground utilities, water wells, or septic tanks.

• Participants must be 12 years or older, physically able to climb 3-foot stairs, and safely handle and throw a 2-pound axe.
   
• Signed waivers are required for all participants. For minors under 18, a parent or guardian must sign on their behalf.
   
• The Company reserves the right to deny participation to any individual who:
   
  • Appears physically or mentally unfit to safely throw an axe.
     
  • Is under the influence of drugs or alcohol.
     
  • Displays misconduct or behavior deemed unsafe or inappropriate.
     

The Company reserves the right to pause or cancel the event due to hazardous weather conditions (e.g., rain, lightning, high winds) that may endanger guests or equipment. In such cases, a reschedule or partial refund may be provided at the Company’s discretion.

The Renter agrees to indemnify and hold harmless Tomahawkin, including all employees, agents, and owners, from any claims, damages, losses, or legal actions arising out of or connected to the event.

The Company is not liable for damages caused by participants, nor is it responsible for damage to the event property. The Renter assumes full responsibility for ensuring the trailer and equipment can be safely accommodated on-site.

Use of Tomahawkin’s intellectual property—including logos, ideas, videos, photos, or recordings—for personal or promotional purposes is strictly prohibited without written permission.

The Renter is responsible for any damage or loss to Company equipment resulting from misuse or negligence by the Renter or participants. The Company is not responsible for damage to the event location due to required trailer or equipment access
